Artifical Intelligence (AI) regulation: The U.S. senate invests in AI Bills; the EU's AI Act gets published

Since the Artificial Intelligence (AI) Act was adopted by the European Union (EU) three month ago, it had to be officially published in the Journal of the EU Commission to have a concrete enforcement date. On July 12th, this has happened with the aim of establishing a harmonized internal market. The AI act entered into force on the August 1st, 2024. This means for all providers, distributors and other actors who participate in the global value chain of an AI system or model, the Act will be applicable latest August 2nd, 2026. Here, the nature of the AI system will determine which set of rules applies, since appropriate risk mitigation measures are entirely dependent on the technologies, in essence can almost be compared to human functions. The general provisions and prohibited AI practices chapter shall apply from February 2nd, 2025, while the rules on GPAI (General Purpose AI) models will administer on August 2nd, 2025. For certain high-risk AI systems, those which need to conduct a third-party conformity assessment, an exception applies - the application date is August 2nd, 2027. All other provisions will apply after the 24-month transitional period, as mentioned: August 2nd, 2026.

However, not only the EU has understood the need of extra regulations for AI. The US Senate Commerce Committee advances 10 AI bills to be introduced for the whole Senate to be considered. These bills concern different standards and requirements up to research and development of mentioned new innovative technologies. Even if these bills are unlikely to advance in next three months, due to the importance of elections, it is not entirely excluded that the AI bills might pass end of  2024.

It is essential to understand that legal entities that are engaged in AI systems need to prepare and acknowledge the legal developments. This plays a key factor in order to comply in time and enable a transparent service which encourages also secure and trustful ties between businesses and also customer relations.
